Avoided Custodial Sentence – Criminal Law

Jerry offered mitigation on behalf of the client urging the Judge to bear in mind the principles in the case of Petherick and Arnold. That is, the Court must uphold the rights of children whose mothers’ have committed offences which could lead to custodial sentences. The client was spared immediate custody because she has an 18 month old daughter and is 27 weeks pregnant.
