Bail hearing – Taylor House
Legis Chambers / 0 Comments /Barrister Sadeghi attended the bail hearing at Taylor House this week for his client. He made submissions in accordance with my skeleton argument, before inviting the Judge to hear from the sureties and called both sureties in turn. The Presenting Officer cross-examined S1 only (she confirmed that she learnt early on in the relationship that the applicant had overstayed). Mr Sadeghi also hand up surety bank statements, wage slips, and photographic identification, as well as a letter of support from the sister and brother-in-law of S1. In closing, the Presenting Officer merely adopts the Bail Summary. Mr Sadeghi briefly summarise additional arguments following on from the evidence of the sureties. Decision The Judge finds that bail will properly deal with the risk in this case. ‘You have no leave to remain, and have been for a very long time,’ however, this is not enough to justify detention in the circumstances. Bail granted.
